Lavorare e vivere negli Stati Uniti

Ogni caso è seguito personalmente dall'Avv.

Green card · Residenza permanente

A green card grants permanent residence in the United States; U.S. citizenship may be applied for later, through naturalization, once the legal requirements are met. Access to some visa categories also depends on the applicant's nationality: visa issuance restrictions currently apply to nationals of certain countries, which we review case by case. The firm does not represent clients before U.S. authorities. The information on this page is general in nature and does not constitute legal advice on any specific case.

Questions about visas and green cards

Who can apply for the EB-2 NIW?
Professionals with an advanced degree (a master's or doctorate, or a U.S. bachelor's degree or foreign equivalent followed by at least five years of progressive experience in the field) or with documented exceptional ability in the sciences, arts or business. Applicants must also show three things: that their proposed endeavor has substantial merit and national importance to the United States; that they are well positioned to advance it; and that, on balance, it would benefit the United States to waive the job offer requirement. Researchers, physicians, engineers, technology professionals and entrepreneurs are among the most common profiles.
What is the difference between the EB-1A and the EB-2 NIW?
Both allow self-petitioning, with no employer or job offer. The EB-1A sets a higher bar: sustained national or international acclaim, shown by a major internationally recognized award or by at least three of the ten criteria set out in the regulations (awards, publications, judging the work of others, high salary, among others). The EB-2 NIW has more accessible requirements but usually a longer wait in the Visa Bulletin. In the initial consultation we assess which route is stronger for your profile.
How long does it take to get a green card?

It depends mainly on two factors: the visa category and your country of birth. The process has three stages:

  • USCIS review of the petition: a few months with regular processing. With premium processing (a paid service with a guaranteed timeframe), a decision is issued within 15 business days for the EB-1A and 45 business days for the EB-2 NIW and EB-1C.
  • Visa Bulletin wait: in the October 2026 Visa Bulletin, there is no wait in EB-1 for people born in most countries, including Brazil and Italy; for the EB-2 NIW the wait is about a year and a half to two years. For people born in India or China, waits are much longer, in some cases over ten years.
  • Consular stage: documents with the National Visa Center and the consular interview, usually from a few months to about a year.

In short, if you were not born in India or China: with the EB-1A, the green card typically takes about one year to a year and a half; with the EB-2 NIW, about two to three years. Temporary visas are much faster: for the O-1A and L-1, the petition can be decided within 15 business days with premium processing, after which the visa is obtained through a consular appointment. Timelines change every month: in the initial consultation we give you an estimate for your case.

Do I need a job offer in the United States?
Not for the EB-1A or the EB-2 NIW: you file the petition yourself. For the EB-1C and the L-1, the petition is filed by the U.S. company, which must belong to the same group as the company you work for abroad. For the O-1A, you need a U.S. employer or agent.
Can my family come with me?
Yes. With employment-based green cards, your spouse and unmarried children under 21 receive green cards together with you as dependents. With temporary visas, family members receive dependent visas (L-2 or O-3): the spouse of an L-1 holder may work in the United States, while dependents of an O-1 holder may study but not work.
I don't live in Italy. Can you help me?
Yes. We work with clients worldwide by video conference, in English, Italian, Portuguese, Spanish and French. The consular interview takes place at the U.S. embassy or consulate in your country of residence. Some nationalities are subject to visa issuance restrictions: we check this in the initial consultation, which is free of charge.
